Terms and Conditions of Sale
Kingdom Advance Network and its affiliates provide access to the KAN Resources shopping site and sell our products and services to you subject to the conditions set out on this page.
Please read these conditions carefully before using this website. By using the KAN Resources shopping site, you signify your agreement to be bound by these conditions. In addition, when you use any current or future KAN service you will also be subject to the guidelines and conditions applicable to that service.
1. The Contract Between Us
We must receive payment of the whole of the price for the goods or services that you order before your order can be accepted. Once payment has been received by us we will confirm that your order has been accepted by sending an email to you at the email address you provide in your order form. Our acceptance of your order brings into existence a legally binding contract between us.
2. Price
2.1 The prices payable for goods or services that you order are as set out in our website.
2.2 You will be required to pay extra for delivery of goods and it might not be possible for us to deliver to some locations. Our delivery charges are set out in our website.
2.3 Despite our best efforts, on rare occasions the prices displayed on our website may contain errors. Where this happens, we will do one of the following:
2.3.1 If the correct price is lower than the price displayed on our website, we will charge you the lower price and fulfill the order; or
2.3.2 If the correct price is higher than the price displayed on our website, we will at our discretion, either contact you for instructions before dispatching the equipment, or cancel your order and notify you of such cancellation.
3. Right for You to Cancel Your Contract
3.1 You may cancel your contract with us for the goods you order at any time up to the end of the seventh working day from the date you receive the ordered goods. You do not need to give us any reason for canceling your contract nor will you have to pay any penalty.
3.2 You cannot cancel your contract if the goods you have ordered are newspapers or magazines or if you have taken any audio or video recording or computer software out of the sealed package in which it was delivered to you.
3.3 To cancel your contract you must notify us in writing.
3.4 If you have received the goods before you cancel your contract then (unless under clause 3.2, you do not have a right to cancel) you must send the goods back to our contact address at your own cost and risk. If you cancel your contract but we have already processed the goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to us at our contact address at your own cost and risk as soon as possible.
3.5 Once you have notified us that you are canceling your contract, any sum debited to us from your credit card will be re-credited to your account as soon as possible and in any event within 30 days of your order PROVIDED THAT the goods in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.
3.6 You will not have the right to cancel if you have ordered services and performance of those services has begun with your agreement. However, this only applies if we have informed you in writing or in another durable medium – before the contract is concluded – that you do not have the right to cancel in such a situation.
4. Cancellation by Us
4.1 We reserve the right to cancel the contract between us if:
4.1.1 We have insufficient stock to deliver the goods or capacity to provide the services you have ordered;
4.1.2 We do not deliver to your area; or
4.1.3 One or more of the goods or services you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
4.2 If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
5. Delivery of Goods to You
5.1 We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order.
5.2 Delivery will be made as soon as possible after your order is accepted and in any event within 30 days of your order.
5.3 You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
5.4 We will not be responsible for any delay in delivery caused by any third party.
5.5 We reserve the right to pass on any subsequent delivery charges, incurred for additional delivery attempts and redirection charges should the recipient be unavailable to sign for goods.
6. Returns
6.1 KAN Resources aim to offer you excellent quality, value and service at all times. If you wish to return an item, all requests must be made by telephone on 01283 534375 within 7 working days of receipt of goods, stating reason for return.
6.2 On returning goods the following must be included: Name and Address, Copy of Invoice, Original Packaging. We will then offer a refund, provided goods are unused and in merchantable condition. CD & DVDs must be returned unopened.
6.4 Please note when issuing a refund postage costs on the original order are not refunded unless the goods are damaged or faulty. Damages incurred due to insufficient packaging become the sole responsibility of the returnee.
6.5 We regret that KAN Resources cannot be held responsible for non-delivery of returned goods, so we recommend you get a certificate of posting from the Post Office.
7. Liability
7.1 If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 10 working days of the delivery of the goods in question.
7.2 If the services we provide are not what you ordered we shall have no liability to you unless you notify us in writing at our contact address of the problem with 10 working days of the delivery of the goods in question.
7.3 If you do not receive the goods or services ordered by you within 30 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 40 days of the date on which you ordered the goods. If you notify a problem to us under this condition, our only obligation will be, at your option:
7.3.1 To make good any shortage or non-delivery;
7.3.2 To correct any typographical errors or minor mistakes caused by us in any material displayed on our website on your behalf;
7.3.3 To replace or repair any goods that are damaged or defective; or
7.3.4 To refund to you the amount paid by you for the goods or services in question in whatever way we choose.
7.4 Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods or services in question under clause 6.2.3 above.
7.5 You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, imports or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export of the goods you purchase.
7.6 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer, under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
8. By registering, you agree to:
8.1 Use the services in accordance these terms and conditions and any instructions issued by us from time to time;
8.2 Give full and accurate details when submitting your registration form or when supplying information requested by us from time to time;
8.3 Grant us a non-exclusive, worldwide, perpetual, irrevocable royalty free license to use any information (including trademarks) you provide to us or other users of our services;
8.4 Ensure that such information shall be legal, decent, honest and truthful, shall not infringe any third party’s rights, shall not contain any viruses or other malicious computer programming routine and shall not link to any other websites;
8.5 Warrant that all the information so requested of and provided by you to us is correct and complete;
8.6 Keep secure any User ID, password and/or any other confidential information provided to you by us for the secure use of the services; and
8.7 Notify us of any unauthorised use of such User ID, password and /or any other confidential information or any other breach of security regarding the services.
9. Notices
Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address at (KAN Resources, The Dream Centre, Hawkins Lane, Burton Upon Trent. DE14 1PT. UK) and all notices from us to you will be displayed on our website from time to time.
10. Events Beyond Our Control
We shall have no liability to you for any failure to deliver goods or services you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstances beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
11. Invalidity
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
12. Privacy
You acknowledge and agree to be bound by the terms of our privacy policy.
13. Third Party Rights
Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.
14. Data Protection
The Buyer acknowledges that the Seller is a data controller for the purposes of the Data Protection Act 1998 and may be required to process personal data in connection with the entering into, performance or enforcement of the Contract. The Buyer in entering into the Contract consents to the Seller processing personal data concerning the Buyer (“opts-in”) and agrees that the Seller may use and disclose personal information about the Buyer to third parties. The Buyer may “opt-out” and cancel such permission at any time by giving written notice to the Seller’s sales office at any time.
15. Laws and Regulations
The Buyer shall comply with all laws and regulations relating to and at its own expense obtain any licences and permits necessary for the purchase, import, ownership and use of the Goods. The Buyer shall produce evidence of such consents to the Seller on demand. The Seller shall not be liable to the Buyer for any use of the goods outside the jurisdiction of England and Wales with respect to national law restrictions on product safety conformance and testing and must itself make all reasonable enquiries itself to satisfy itself that the goods to be purchased from the Seller conform to local law as the Seller expressly makes no representations or warranties on such matters.
16. Governing Law
The contract between us shall be governed by and interpreted in accordance with English law and the English courts have jurisdiction to resolve any disputes between us.
17. Entire Agreement
These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
